Delivery terms, shipping and liability

Products purchased on the website poderedippolito.it are delivered to the address indicated by the Customer when ordering.

Shipments will be made after receiving confirmation of payments; for Bank Transfer the credit to our bank account is valid, for payment by credit card the confirmation of transaction by the circuit.

Only domestic couriers with tracking codes will be used for shipments.

Shipping costs for Italy

The tariff calculation is generated automatically based on the weight of the selected products, based on the following fee schedule:

Delivery time

Usually deliveries take place within 3/5 working days for Italy and in 7/10 for abroad, on products available in stock. The shipping terms indicated on the site, while carefully evaluated, must be understood as not binding for Azienda Agricola Angelina D’Ippolito, which may subsequently confirm or modify them, depending on its actual needs. Shipping times are indicated in working days.

Any delays in delivery of less than 30 (thirty) days shall not entitle the Customer to refuse delivery of the Products, nor to claim any compensation or indemnity whatsoever.

Delivery is considered completed from the moment the Product is delivered to the Customer.

The delivery document issued by the carrier, dated and signed by the Customer upon delivery of the Product, shall constitute evidence in the matter of transportation and release of the good.

It is important to know that upon delivery, the Customer must verify the content, conformity and condition of the Product(s). Therefore, upon delivery, L’Azienda Agricola Angelina D’Ippolito recommends that the Customer proceed to verify the status of the delivered Product(s) before signing the acknowledgement of receipt, and in particular that:

the number of packages being delivered corresponds to what is indicated in the transport document attached to the shipment;

the packaging is intact, not damaged, wet or otherwise altered, and to check the integrity of the contents.

If the Customer notices any anomalies, it is necessary to accept the delivery of the package “with reservation “and ask the courier to report through the PDA or otherwise refuse the delivery.

Product pickup in case of Customer’s absence

In the event that the recipient is absent during delivery, the carrier will leave a passing notice at the delivery address indicated by the Customer. The Products shall be picked up at the address and in the manner specified by the carrier.

In case of failure to collect the Products within the time limit set by the carrier, the Products will be returned to Azienda Agricola Angelina D’Ippolito, which reserves the right to refund the price of the Products, leaving the shipping costs to be borne by the Customer.

Canceling an order

The Customer has the right to cancel an order placed on the site www.poderedippolito.it before the package(s) are picked up by the courier. When – in the appropriate order section on your profile – the order status changes from “in preparation” to “shipped” you will no longer be able to cancel it.

Right of Withdrawal

8.1 Pursuant to art. 5 of Legislative Decree 22 May 1999 n. 185, the Customer (if it qualifies as a “consumer” under art.1 lett b) of Legislative Decree 22 May 1999 n. 185) has the right to terminate the contract and return the Products ordered, without penalty and without specifying the reason, within 10 (ten) working days from receipt of the Products.

8.2 The right of withdrawal referred to in Article 9.1 above must be exercised by the Customer, under penalty of forfeiture, by sending a registered letter with return receipt to Azienda Agricola Angelina D’Ippolito in Via degli Itali, 81 – 88046 Lamezia Terme (CZ) Italy, within the term of 10 (ten) working days from receipt of the Products.

8.3 All returns (which must be perfectly intact and accompanied by the original packaging) must be authorized by Customer Service (info@poderedippolito.it). Once the return has been authorized, the Customer may return the Product to the following address: Azienda Agricola Angelina D’Ippolito – Via degli Itali, 81 88046 Lamezia Terme (CZ) Italy. C.O.D. packages will not be accepted.

8.4 Upon receipt of the Products (and verification of their integrity).

Azienda Agricola Angelina D’Ippolito will, as soon as possible, credit the Customer with the cost of the returned Products (as indicated on the invoice), withholding the amount of shipping costs that will remain definitively borne by the Customer.

8.5 The right of withdrawal referred to in Article 8.1 above may not be exercised by the Customer in the event that the Products purchased consist of bottles of oil that have been opened by the Customer himself or if the items being sold had been ordered and produced expressly on the order of the customer. In case of damage to the property during the transport of the returned goods, Azienda Agricola Angelina D’Ippolito will notify the Customer of the incident (within 5 working days of receipt of the goods in their warehouses), to enable him to file a timely complaint against the carrier of his choice and obtain reimbursement of the value of the property (if insured); in this case, the Product will be made available to the Customer for its return, simultaneously canceling the request for withdrawal. Azienda Agricola Angelina D’Ippolito is not liable in any way for damage or theft/loss of goods returned by uninsured shipments. During the withdrawal period mentioned in Article 15, the Customer is responsible for the object as custodian. In case of damage or destruction of the Product during the custody of the Customer, the right of withdrawal will be forfeited.

Jurisdiction

In the event of litigation and in the absence of an amicable agreement reached between the parties, without prejudice to the possible applicability of mandatory provisions of law placed to protect consumers (as defined pursuant to art.1 lett. b) of Legislative Decree no. 185 of 22 May 1999), any dispute in any way related to these General Conditions, will be devolved to the exclusive jurisdiction of the Court of Lamezia Terme.
